The website located at www.thetahedge.io and any associated applications, dashboards, tools, APIs, analytics engines, widgets, or related services (collectively, the "Platform") are owned and operated by ThetaHedge Technologies, Inc. ("ThetaHedge," "Company," "we," "us," or "our").
By accessing or using the Platform, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Platform.
By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
1. Educational & Informational Purposes Only
All data, analytics, models, metrics, rankings, projections, calculations, visualizations, dashboards, and other outputs provided by ThetaHedge (collectively, the "Information") are provided for informational and educational purposes only. ThetaHedge is not a registered investment advisor, broker-dealer, or asset manager and does not provide personalized investment advice, execute trades, or manage assets.
Nothing on the Platform constitutes investment advice, trading recommendations, tax advice, legal advice, or a solicitation to buy or sell securities. All trading decisions are made solely at your discretion.
2. Risk Disclosure – Options & Securities
You acknowledge and understand that trading options involves a high degree of risk and may result in substantial losses. Selling options exposes you to potentially significant downside risk. Trading options involves material risks, including but not limited to assignment risk, liquidity risk, volatility risk, earnings risk, gap risk, and general market risk. Past performance is not indicative of future results, and backtested or modeled data does not guarantee future performance.
You assume full responsibility for all trading activity and financial outcomes. ThetaHedge shall not be liable for trading losses, missed opportunities, margin calls, assignment events, portfolio drawdowns, tax consequences, or any other financial outcomes arising from your use of the Platform.
3. Data Accuracy & Third-Party Providers
Market data, options chains, earnings dates, and financial fundamentals are obtained from independent third-party data providers. ThetaHedge generates proprietary analytics, metrics, rankings, and derived calculations based on such data.
Neither the underlying data nor any derived analytics are guaranteed to be accurate, complete, timely, available, or free from errors or omissions. Computational errors, model limitations, system interruptions, or data delays may occur.
All data and analytics are provided on an "AS IS" and "AS AVAILABLE" basis.
You agree not to rely solely on the Platform when making trading decisions and to independently verify information before executing any transaction.
4. No Guarantee of Strategy Performance
Metrics and analytics provided by ThetaHedge, including but not limited to Wheel Rank, Assignment Risk Indicator (ARI), volatility rankings, open interest and volume rankings, yield calculations, historical performance data, and projected returns, are analytical tools only and do not constitute guarantees of profitability or performance.
ThetaHedge does not guarantee positive returns, income generation, risk reduction, assignment avoidance, portfolio protection, or any specific trading outcome. Analytics, rankings, and metrics may change over time and may not function as expected in all market conditions. ThetaHedge does not guarantee the continued effectiveness or reliability of any model or metric.
5. Accounts, Free Trial & Subscriptions
Certain features of the Platform require registration and a paid subscription.
Account Responsibilities
By creating an account, you agree that:
- You will provide accurate, current, and complete registration information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are fully responsible for all activity that occurs under your account.
- You will promptly notify ThetaHedge of any unauthorized use of your account.
14-Day Free Trial
ThetaHedge may offer a fourteen (14) day free trial to new users. No payment information is required to access the trial.
ThetaHedge reserves the right to limit trial eligibility, restrict multiple trial activations, and suspend or terminate accounts created to circumvent trial limitations.
At the conclusion of the trial period, continued access to paid features of the Platform requires an active paid subscription. If you do not subscribe at the end of the trial period, your access to paid features will automatically terminate.
Paid Subscriptions & Auto-Renewal
Paid subscriptions automatically renew at the end of each billing cycle unless canceled prior to renewal.
Payment processing services are provided by third-party payment processors, including Stripe, and are subject to the terms and privacy policies of such providers.
By subscribing, you authorize ThetaHedge to charge your designated payment method for recurring subscription fees at the then-current rate.
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.
All fees are non-refundable except where required by applicable law.
Suspension or Termination
ThetaHedge reserves the right to suspend or terminate accounts at its sole discretion, including for violations of these Terms or misuse of the Platform.
6. License & Intellectual Property
Subject to these Terms, ThetaHedge grants you a limited, non-exclusive, non-transferable, revocable license to access the Platform.
You may not:
- Copy, reproduce, redistribute, resell, or republish data
- Scrape, automate, spider, or systematically download data
- Reverse engineer, decompile, disassemble, or attempt to derive the formulas, algorithms, source code, or underlying logic of any analytics, metrics, or models
- Build a competing product using Platform data
- Share login credentials
All intellectual property, including:
- Metrics
- Rankings
- Models
- UI/UX design
- Databases
- Code
- Branding
- Logos
are owned exclusively by ThetaHedge Technologies, Inc.
Any unauthorized use of the Platform or its intellectual property is strictly prohibited and may result in suspension of access and/or legal remedies available under applicable law.
7. Prohibited Conduct
You agree not to:
- Use the Platform for unlawful purposes
- Violate securities laws
- Circumvent subscription controls
- Attempt unauthorized access
- Interfere with system security
- Redistribute proprietary data
8. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."
THETAHEDGE DISCLAIMS ALL WARRANTIES, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- ACCURACY
- NON-INFRINGEMENT
- UNINTERRUPTED SERVICE
We do not guarantee that the Platform will:
- Be error-free
- Be uninterrupted
- Be secure
- Be free from viruses, malicious code, or other harmful components.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THETAHEDGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, PORTFOLIO DECLINES, LOST PROFITS, LOST DATA, OR LOST OPPORTUNITY, ARISING OUT OF OR RELATED TO USE OF THE PLATFORM.
IN NO EVENT SHALL THETAHEDGE'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE PLATFORM EXCEED THE TOTAL AMOUNT PAID BY YOU TO THETAHEDGE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless ThetaHedge, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:
- Your trading activity
- Your use of the Platform
- Your violation of these Terms
11. Arbitration & Dispute Resolution
Any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration under the Federal Arbitration Act.
Arbitration shall be conducted:
- On an individual basis
- Not as a class action
- In the State of New Jersey
You waive any right to a jury trial.
12. Modification of Platform
ThetaHedge reserves the right, at its sole discretion, to modify, suspend, remove, update, or discontinue any feature, functionality, analytics model, pricing structure, or component of the Platform at any time, with or without notice.
Where reasonably practicable, ThetaHedge may provide notice of material changes.
13. No Fiduciary Relationship
Your use of the Platform does not create:
- A fiduciary relationship
- An advisory relationship
- A partnership
- A joint venture
You are solely responsible for your investment decisions.
14. Export Compliance
You agree to comply with applicable U.S. export laws.
15. Entire Agreement
These Terms constitute the entire agreement between you and ThetaHedge regarding use of the Platform.
